When you place an order, you are making an offer to purchase. HeartRehab reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until HeartRehab confirms acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as HeartRehab may be unable to accommodate cancellation requests after an order is accepted. In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the e‑mail, billing address, and/or phone number provided at the time the order was made.
Your purchases are subject to return or exchange solely in accordance with our Refund Policy.
You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.
SECTION 4 - PRICES AND BILLING
Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, customs or import charges.

SECTION 5 - SHIPPING AND DELIVERY
We are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control. Once we transfer products to the carrier, title and risk of loss passes to you.

All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.

You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor have any control nor input.

HeartRehab is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with HeartRehab. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and HeartRehab, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with HeartRehab.

You agree to indemnify, defend and hold harmless HeartRehab, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable attorneys’ fees, payable to any third party due to or arising out of (1) your breach of these Terms of Service or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.
We will notify you of any indemnifiable claim, provided that a failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced. Salvo lo expresamente establecido en estos Términos, nada aquí otorga ni se interpretará como que otorga una licencia u otros derechos sobre cualquier patente, marca, derecho de autor u otra propiedad intelectual de HeartRehab, Shopify o de terceros. El uso no autorizado de los Servicios puede violar leyes de propiedad intelectual. Todos los derechos no otorgados expresamente se reservan por HeartRehab.
Los nombres, logotipos, nombres de productos y servicios, diseños y eslóganes de HeartRehab son marcas de HeartRehab o de sus afiliados o licenciantes. No debes usar dichas marcas sin el permiso previo por escrito de HeartRehab. El nombre, logotipo, nombres de productos y servicios, diseños y eslóganes de Shopify son marcas de Shopify. Todos los demás nombres y marcas mostrados en los Servicios son propiedad de sus respectivos dueños.
SECCIÓN 7 - HERRAMIENTAS OPCIONALES
Es posible que se te proporcione acceso a herramientas ofrecidas por terceros como parte de los Servicios, las cuales no monitoreamos ni controlamos ni sobre las que tenemos participación.
Reconoces y aceptas que proporcionamos acceso a dichas herramientas “tal cual” y “según disponibilidad”, sin garantías, declaraciones ni condiciones de ningún tipo y sin respaldo alguno. No tendremos responsabilidad alguna derivada de o relacionada con tu uso de herramientas opcionales de terceros.
Cualquier uso de herramientas opcionales ofrecidas a través del sitio es bajo tu propio riesgo y discreción, y debes asegurarte de estar familiarizado/a con los términos bajo los cuales dichas herramientas son proporcionadas por el/los proveedor(es) externo(s).
En el futuro, también podemos ofrecer nuevas funciones a través de los Servicios (incluyendo el lanzamiento de nuevas herramientas y recursos). Dichas nuevas funciones también se considerarán parte de los Servicios y estarán sujetas a estos Términos de Servicio.

Los Servicios pueden contener materiales e hipervínculos a sitios web proporcionados u operados por terceros (incluyendo funcionalidades de terceros integradas). No somos responsables de examinar o evaluar el contenido o la exactitud de los materiales o sitios web de terceros a los que decidas acceder. Si decides salir de los Servicios para acceder a dichos materiales o sitios de terceros, lo haces bajo tu propio riesgo.
No somos responsables de ningún daño o perjuicio relacionado con tu acceso a sitios web de terceros, o tu compra o uso de productos, servicios, recursos o contenido en sitios de terceros. HeartRehab funciona con Shopify, que nos permite proporcionarte los Servicios. Sin embargo, cualquier venta o compra que realices en nuestra Tienda se realiza directamente con HeartRehab. Al usar los Servicios, reconoces y aceptas que Shopify no es responsable de ningún aspecto de las ventas entre tú y HeartRehab, incluyendo cualquier lesión, daño o pérdida derivada de productos o servicios comprados. Por la presente, liberas expresamente a Shopify y a sus afiliados de cualquier reclamación, daño o responsabilidad derivada de o relacionada con tus compras y transacciones con HeartRehab.

Aceptas que tu Feedback no violará derechos de terceros, incluyendo derechos de autor, marcas, privacidad, imagen u otros derechos personales o de propiedad. Asimismo, aceptas que tu Feedback no contendrá contenido difamatorio, ilegal, abusivo u obsceno, ni contendrá virus informáticos o malware que pueda afectar el funcionamiento de los Servicios. (g) para transmitir o procurar el envío de publicidad o material promocional, incluyendo “spam”, “cadena”, “correo basura” u otras solicitudes similares;
(h) para suplantar o intentar suplantar a otra persona o entidad; o
(i) para realizar conductas que restrinjan o inhiban el uso o disfrute de los Servicios, o que puedan perjudicar a HeartRehab, Shopify o a usuarios, o exponerlos a responsabilidad.
Además, aceptas no:
(a) subir o transmitir virus o código malicioso;
(b) reproducir, duplicar, copiar, vender, revender o explotar cualquier parte de los Servicios;
(c) recopilar o rastrear información personal de otros;
(d) hacer spam, phishing, pharming, pretexting, spider, crawl o scrape; o
(e) interferir o eludir las funciones de seguridad de los Servicios o de cualquier sitio relacionado.
Nos reservamos el derecho de suspender, deshabilitar o terminar tu cuenta en cualquier momento, sin aviso, si determinamos que has violado cualquier parte de estos Términos.
SECCIÓN 14 - TERMINACIÓN
Podemos terminar este acuerdo o tu acceso a los Servicios (o cualquier parte de los mismos) a nuestra entera discreción en cualquier momento sin aviso, y seguirás siendo responsable de todas las cantidades adeudadas hasta la fecha de terminación inclusive.

La información presentada en o a través de los Servicios se pone a disposición únicamente con fines informativos generales. No garantizamos la exactitud, integridad o utilidad de esta información. Cualquier confianza que deposites en dicha información es bajo tu propio riesgo. Renunciamos a toda responsabilidad derivada de la confianza depositada en dichos materiales por ti o por cualquier visitante.
SALVO QUE HeartRehab INDIQUE EXPRESAMENTE LO CONTRARIO, LOS SERVICIOS Y TODOS LOS PRODUCTOS OFRECIDOS A TRAVÉS DE LOS SERVICIOS SE PROPORCIONAN “TAL CUAL” Y “SEGÚN DISPONIBILIDAD”, SIN GARANTÍAS NI CONDICIONES DE NINGÚN TIPO, EXPRESAS O IMPLÍCITAS, INCLUYENDO GARANTÍAS IMPLÍCITAS DE COMERCIABILIDAD, CALIDAD COMERCIAL, IDONEIDAD PARA UN PROPÓSITO PARTICULAR, DURABILIDAD, TITULARIDAD Y NO INFRACCIÓN. NO GARANTIZAMOS QUE EL USO DE LOS SERVICIOS SEA ININTERRUMPIDO, PUNTUAL, SEGURO O LIBRE DE ERRORES. ALGUNAS JURISDICCIONES LIMITAN O NO PERMITEN LA EXENCIÓN DE CIERTAS GARANTÍAS, POR LO QUE LA EXENCIÓN ANTERIOR PUEDE NO APLICARTE.
SECCIÓN 16 - LIMITACIÓN DE RESPONSABILIDAD
EN LA MÁXIMA MEDIDA PERMITIDA POR LA LEY, EN NINGÚN CASO HeartRehab, NUESTROS SOCIOS, DIRECTORES, FUNCIONARIOS, EMPLEADOS, AFILIADOS, AGENTES, CONTRATISTAS, PROVEEDORES DE SERVICIOS O LICENCIANTES, O LOS DE SHOPIFY Y SUS AFILIADOS, SERÁN RESPONSABLES POR LESIONES, PÉRDIDAS, RECLAMOS O DAÑOS DIRECTOS, INDIRECTOS, INCIDENTALES, PUNITIVOS, ESPECIALES O CONSECUENTES DE CUALQUIER TIPO, INCLUYENDO, SIN LIMITACIÓN, PÉRDIDA DE GANANCIAS, INGRESOS, AHORROS, DATOS, COSTOS DE REEMPLAZO O CUALESQUIERA DAÑOS SIMILARES, YA SEA POR CONTRATO, RESPONSABILIDAD EXTRACONTRACTUAL (INCLUYENDO NEGLIGENCIA), RESPONSABILIDAD ESTRICTA O DE OTRO TIPO, DERIVADOS DE TU USO DE LOS SERVICIOS O DE PRODUCTOS ADQUIRIDOS, O POR CUALQUIER OTRA RECLAMACIÓN RELACIONADA CON TU USO DE LOS SERVICIOS O CUALQUIER PRODUCTO, INCLUYENDO ERRORES U OMISIONES EN CUALQUIER CONTENIDO, O CUALQUIER PÉRDIDA O DAÑO DERIVADO DEL USO DE LOS SERVICIOS O CUALQUIER CONTENIDO (O PRODUCTO) PUBLICADO, TRANSMITIDO O PUESTO A DISPOSICIÓN A TRAVÉS DE LOS SERVICIOS, INCLUSO SI SE NOS HUBIERA ADVERTIDO DE LA POSIBILIDAD.
SECCIÓN 17 - INDEMNIZACIÓN
Aceptas indemnizar, defender y mantener indemne a HeartRehab, Shopify y a nuestros afiliados, socios, directores, empleados, agentes, contratistas, licenciantes y proveedores de servicios frente a pérdidas, daños, responsabilidades o reclamaciones, incluyendo honorarios razonables de abogados, pagaderos a terceros debido a o derivados de (1) tu incumplimiento de estos Términos o documentos incorporados por referencia, (2) tu violación de cualquier ley o derechos de terceros, o (3) tu acceso y uso de los Servicios.
Te notificaremos cualquier reclamación indemnizable, siempre que la falta de notificación inmediata no te libere de tus obligaciones, salvo que te cause un perjuicio material. Podemos controlar la defensa y el acuerdo de dicha reclamación a tu cargo, incluyendo la elección del abogado, pero no acordaremos ningún acuerdo que requiera obligaciones no monetarias por tu parte sin tu consentimiento (que no será denegado de forma irrazonable). Cooperarás en la defensa, incluyendo proporcionando documentos relevantes.
SECCIÓN 18 - DIVISIBILIDAD
Si alguna disposición de estos Términos se determina como ilegal, nula o inaplicable, dicha disposición será aplicable en la máxima medida permitida por la ley aplicable, y la parte inaplicable se considerará separada de estos Términos, sin afectar la validez y aplicabilidad del resto de las disposiciones.
